This agreement applies between you, the User of this Website and magnetictherapy.co.uk the owner of this Website. Your agreement to comply with and be bound by Clauses 1 ? 9 and 13 ? 25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 10 ? 12 apply only to the sale of Goods. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

2. Age Restrictions

2. Under the Criminal Justice Act 1988 it is an offence to purchase or attempt to

5. In accepting these Conditions, you agree to Magnetictherapy.co.uk you are of 


correct age in accordance with the Criminal Justice Act 1988, the?Anti-Social

Website you represent and warrant that:

10. Goods, Pricing and Availability

4. All pricing information on the Website is correct at the time of going online. We 


reserve the right to change prices and alter or remove any special offers from time

price, even after we have sent you a Dispatch Confirmation, if the pricing error is

subject to validation checks and authorisation by the card issuer. If the issuer of your 


payment card refuses to or does not, for any reason, authorise payment to us, we 


will not be liable for any delay or non-delivery.


11. Orders and Delivery

1. No part of this Website constitutes a contractual offer capable of acceptance. Your 


order constitutes a contractual offer that We may, at Our sole discretion, accept. 


When you place an order with us by pressing the ?Confirm & Pay? button on the 


purchasing page you are making Us an offer to purchase product(s) from Us. Our 


acceptance is indicated by Us sending to you a dispatch confirmation email & taking 


payment. Only once We have sent you a dispatch confirmation email will there be a 


binding contract between magnetictherapy.co.uk and you.


2. The Contract will relate only to those Products whose dispatch we have confirmed in 


the Dispatch Confirmation. We will not be obliged to supply any other Products 


which may have been part of your order until the dispatch of such Products has been 


confirmed in a separate Dispatch Confirmation.


3. In the event that prior to the Dispatch Confirmation, we find that we are unable to 


satisfy your order for any reason (such as falling levels of stock) we will attempt to 


make contact with you in order to offer you any available alternatives.


4. Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation 


or, if no delivery date is specified, all Goods purchased by you will be delivered 


within 30 calendar days of Our order confirmation.


5. Goods dispatched via Royal Mail, regardless of service selected, cannot be confirmed 


as lost or investigated into their whereabouts until a minimum of 13 working days 


after the expected delivery date quoted during the checkout process.


6. The Goods will be at your risk from the time of delivery. Ownership of the Goods will 


only pass to you when We receive full payment of all sums due in respect of the 


Goods, including delivery charges, or on delivery, whichever is the latter.


7. If you chose to collect your order from Our store, date for collection will be agreed 


with you when you place your order. Please note that you will be unable to collect 


your order earlier than the agreed time and/or date. Should you arrive late, you will 


still be able to collect your order. Please bring your order number and the credit card 


you used to pay for your order (we will not be able give you your order unless you 


produce an appropriate form of I.D.) Whilst we make every effort to have your order 


ready for collection at the agreed time, please note we will not be liable if we fail to 


do so in part or in full due to circumstances beyond our control.


12. Returns Policy


Magnetictherapy.co.uk aims to always provide high quality Goods that are fault free and 


undamaged. On occasions however, Goods may need to be returned. Returns are governed 


by these Terms and Conditions. Refer to our Returns Information section of the website (all 


links at bottom of this page) to help you process Returns.


1. If you receive Goods which do not match those that you ordered, you should contact 


Us within 14 calendar days to arrange a return. You will be given the option to have 


the Goods replaced with those ordered (if available) or to be refunded through the 


payment method used by you when purchasing the Goods. Replacements will be 


issued upon Our receipt of the returned Goods. We are fully responsible for paying 


shipment costs. Goods must be returned in their original condition with all packaging 


and documentation. The packaging does not need to be unopened. Refunds will be 


issued as soon as possible and, in any case, within 14 calendar days after receipt of 


the returned Goods. We regret that additional costs such as express delivery and 


gift-wrapping cannot be refunded. 


2. If Goods are damaged in transit and the damage is apparent on delivery, you should 


sign any applicable delivery note to the effect that the Goods have been damaged. 


?Damage must be reported to us as soon as noticed and within 72 hours of delivery. 


?To return the damaged Goods, contact must be made with Us within 14 calendar 


days to arrange a return. We are fully responsible for paying shipment costs. You will 


be given the option to have the Goods replaced or to be refunded in full or partial 


through the payment method used by you when purchasing the Goods. 


Replacements will be issued upon Our receipt of the returned Goods. Refunds will be 


issued as soon as possible and, in any case, within 14 calendar days after receipt of 


the returned Goods. We regret that additional costs such as express delivery and 


gift-wrapping cannot be refunded.


3. If any Goods you have purchased have faults when they are delivered to you, you 


should contact Us within 14 calendar days to arrange a return. You will be given the 


option to have the Goods replaced or to be refunded through the payment method 


used by you when purchasing the Goods. We are fully responsible for paying 


shipment costs. Replacements will be issued upon Our receipt of the returned 


Goods. Refunds will be issued as soon as possible and, in any case, within 14

4. If any Goods you have purchased develop faults within 30 calendar days of delivery, 


you may be entitled to a replacement or a refund. In order to arrange for such, you 


should contact Us within the 30 calendar day period to arrange collection and 


return. We will assess the Goods and alleged faults upon receipt and if We conclude 


(at Our sole discretion, acting reasonably and in good faith) determine that the fault 


is not a result of mistreatment by you (deliberate, negligent or otherwise), We will 


issue replacement Goods at no additional cost to you or a refund.


5. If any Goods develop faults beyond 30 calendar days from delivery but within their 


warranty period, you are entitled to a repair or replacement under the terms of that 


warranty. Magnetictherapy.co.uk is not a party to such warranties and you must 


therefore contact the manufacturer of the Goods directly.


6. If you are a consumer based within the European Union, you have a statutory right 


to a ?cooling off? period. This period begins once your order is complete and ends 14 


calendar days after the Goods have been delivered to you. If the Goods are delivered 


to you in instalments, the 14 calendar day period begins on the day that you receive 


the final instalment. If you change your mind about the goods within this period, 


please inform Us within 14 calendar days of receipt. Goods must be returned to Us 


within 14 calendar days of the day on which you inform Us that you wish to return 


the Goods. You are responsible for paying return shipment costs if Goods are 


returned for this reason. Refunds will be issued as soon as possible and, in any case, 


within 14 calendar days after you inform Us that you wish to cancel under this 


provision and will include any delivery of us sending the Goods to you. We regret 


that additional costs such as Speedy / Priority delivery and gift-wrapping cannot be

period of the following types of Goods and/or taking into account the following 




1. Goods made to your specifications or that have been personalised;


2. Goods which are liable to deteriorate or expire rapidly;


3. Goods which are sealed for health or hygiene reasons that have been unsealed after 




4. Goods which are, after delivery, according to their nature, inseparably mixed with other

CD-ROM?s) in sealed packaging where the seal has been broken after delivery;

them to the extent necessary to establish the nature, characteristics and functioning of 


them (such as you would, for example, handle a display item in a shop). Please note that 


opening packaging does not prevent you from returning Goods unless the Goods fall under 


sub-Clauses 12.7.3 or 12.7.5 and in any event does not include the opening of delivery 


packaging, only the packaging of the product itself. You have a legal obligation to take 


reasonable care of the Products while they are in your possession. If you fail to comply with 


this obligation, we may have a right of action against you for compensation.
